Terms & Conditions

AGREEMENT

This Bidder Agreement ("Agreement") is entered into between the person bidding on the online format (referred to herein as either "Bidder" or "Buyer") and Quad City Auctions, or its assignee ("Auctioneer"), (together, Bidder/Buyer and Auctioneer are referred to herein as the "Parties"). Bidder agrees to be bound by the terms of this Agreement with respect to all sales and auctions conducted by Auctioneer. Bidder acknowledges that additional terms to this Agreement may be posted within individual sales and/or announced and such additional terms are deemed incorporated into this Agreement by this reference and are binding on Bidder.

REGISTRATION and PLACING A BID

For the security and fairness of the auction process, registration (personal or business information) with a valid credit/debit card is required for placing a bid and is an agreement to purchase. There is no deposit required and no charges will be assessed. If you win, you must pick up your item(s) or make delivery/shipping arrangements.

ITEM CONDITION and WARRANTY

No statement regarding condition, kind, value, or quality of a lot, whether written or made orally at any time on this website or elsewhere, shall be construed to be an express or implied warranty, representation, or assumption of liability. Quad City Auctions does not guarantee the condition, validity of authenticity or functionality of items being sold. Any such warranty is waived. All sales are final and no sale rescissions will be made for any reasons – no exceptions. Quad City Auctions offer no warranties of any kind. All items sold at the auction on behalf of the seller and are sold AS-IS, where is, with all faults, without warrant of any kind or nature and are not subject to return. No statement (oral or written) in print or catalog (online or in print) by auctioneer, staff or seller (or by their respective agents) at any time shall be construed as a warranty of any kind, express or implied. Statements made regarding any item are statements of opinion only.

BIDDER INSPECTION

Bidder is encouraged to contact Quad City Auctions directly for any inquiries prior to bidding. Auctioneer will do their best to arrange periods of inspection when time permits. Please understand that not all items are available in the same locations and not all items are fully accessible prior to the auction date. Inspection will be decided and done in person on a case-by-case basis.

ITEM INACCURACIES

Quad City Auctions will do their best to offer as much information as possible for items being sold.  However, much like condition and warranty, Quad City Auctions will not be held liable for any inaccurate descriptions of items regarding condition, functionality, model, age or authenticity.

RESERVES

Occasionally, seller(s) may request that an item is to have a “reserve” or minimum starting bid amount. This allows for seller(s) to retain ownership of item being auctioned and will not be complete unless the reserve or minimum bid price has been met. In the case of a minimum bid amount, the item(s) is considered actively for sale once the opening bid has been made. For reserve auction items bids may be placed without the reserve price achieved and the current price shown will always reflect the highest amount bid. Once the reserve price has been met the item(s) is considered actively for sale and proxy bidding will go into effect. Quad City Auctions will not reveal reserve prices as per agreement with the seller(s).

THE BUNDLE

“THE BUNDLE” lot will occasionally show up at the end of an auction event. This lot consists of ALL UNSOLD ITEMS within the auction event it is posted. Any lots or items that have received Zero Bids are considered to be UNSOLD and will be placed into one BUNDLE lot. The amount of lots within this listing will be determined at the end of the auction and can be followed by watching zero bid items. THE BUNDLE listing will be removed if all prior lots have successful bids and there will be no charge for the lot.
**Items with starting bids of $10 or higher and/or Reserve Price items are NOT included in The Bundle

ALL SALES ARE FINAL

All items are sold AS-IS, Where-Is. No refunds, deductions or allowances will be given, and all chargebacks will be denied, per these Terms and Conditions.

AUCTION ENDING and EXTENSIONS

Quad City Auctions utilizes a staggered auction closing on all items listed.  This means that each item will close 30 seconds before the next item.  An item’s closing time may be extended if a bid is placed within 1 minute from the time of its closing.  The length of the extension will be 60 seconds from the point at which the bid was made. Each time a bid is placed within this “extension period," the item will automatically extend an additional 60 seconds.  This is designed and utilized to prevent what is commonly known as "sniping," which is the act of attempting to "steal" an item within the closing seconds of an auction.

PAYMENT

Invoices will be sent out via email and available for review within your registered account once the sale has completely closed. Buyer understands and agrees that the 13% buyer's premium per Lot purchased will be automatically included in the final settlement figure, and the buyer will be required to pay all applicable taxes, or other fees levied by any authority. Current tax rate for the City of Prescott is 8.35%. Accepted forms of payment are Visa, MasterCard, American Express, Discover, Money Order / Cashier’s Check, Cash, Personal Check and PayPal. Please contact us directly if you are planning to pay in person vs. electronically online.

TAX EXEMPT STATUS

Any bidder that claims tax-exempt status, must provide the appropriate documentation PRIOR to placing your first bid.  A copy of the current state’s tax-exempt form (AZ5000 or 5000A) along with a copy of the state tax ID must be provided BEFORE placing any bids.  Failure to do so will result in the bidder being charged sales tax on any items won, prior to Quad City Auctions receiving the required documentation.

LIABILITY and ARBITRATION

Quad City Auctions assumes no responsibility for the damage, inaccuracy, or abandonment of any items listed and won. In the event litigation occurs buyer(s) waives venue and agrees to pay all costs and expenses including attorney’s fees. Buyer(s) agrees to release liability from Quad City Auctions, its owner(s), employees, associates and affiliates against all claims, suits, liens, judgements, damages, losses and expenses.

LOSS of BIDDING PRIVILEGES

If you default on your purchase, your bidding privileges will be revoked permanently. Do not bid if you do not plan to purchase. Failure to pick up your auction winnings and abuse of this action will result in the loss of bidding privileges.  Attempting credit/debit card chargebacks will result in the loss of bidding privileges. Please contact us directly with your dispute. Offensive or abusive behavior towards any staff member, other patron or consignor will result in account privileges being revoked permanently. If you are witness to or a victim of such behavior, please contact a Quad City Auctions staff member immediately.

ITEM PICK UP

Please do not bid if you are unable to pick up your items or if you have not made prior arrangements through Quad City Auctions. All items purchased must be picked-up during the scheduled pick-up times and location.  Bring necessary tools and help for pick-up. Loading help is NOT available. Items may be located on a 2nd floor, basement or out building. If this is a concern, please inquire prior to bidding. Absolutely NO refunds or chargebacks will be granted due to failure, inability or change of heart to pick-up purchased items at the designated times and location.  Purchased items in which the Purchaser fails to pick-up will be considered abandoned by Purchaser and the further disposition of such purchased items will be at the sole discretion of Quad City Auctions.

ITEM LOCATION(S)

All item locations for pick up will be listed under the terms of each individual sale. Quad City Auctions base location is 1040 Sandretto Dr Unit K Prescott, AZ. This is described as the "WAREHOUSE PICK UP". Any onsite locations will be listed with a city and general location. Exact address will be given to buyers after auction close.

SHIPPING

Shipping is available at the buyer's expense.  NOT ALL LOTS CAN BE SHIPPED - NO SHIPPING ON FURNITURE, RUGS, OR OTHER LARGE ITEMS. If you require shipping, you MUST contact Quad City Auctions and receive approval prior to bidding. We will assist in utilizing the most practical and affordable method of shipping through outside sources. Quad City Auctions does not provide in-house shipping services.

DELIVERY

Delivery is available upon arrangement prior to bidding. Delivery fees are based on a case-by-case scenario and are calculated with respect to size, amount, weight and distance. Please inquire for more information. Buyer is welcome to arrange delivery on their own with outside sources.

STORAGE and TRANSFER FEES

If you are unable to come to the scheduled pickup time, it is the winning bidder's responsibility to send someone on their behalf with a valid driver's license and a PAID invoice. Items not picked up on the scheduled pickup day are subject to a transport fee (if pick up is onsite) starting at $25 per lot (based on size and weight) and storage fees starting at $10 per lot per day (based on size and weight). If items(s) remain unclaimed after 1 week of the auction end date they will be considered forfeited with no refund given.

RIGHTS RESERVED by QUAD CITY AUCTIONS

Quad City Auctions reserves the right to end, delay, or extend the length of any auction, or time of pick-up, for any reason, at any time.  In addition, any item may be removed from the online auction at any time, without warning. Quad City Auctions also reserves the right to refuse sale, at any time, before payment is made.
